Rule 58
Auction arrangement
(1) Among the goods that are old, unserviceable, broken, unserviceable and cannot be repaired, the goods determined by the head of the office to be auctioned, up to three lakh rupees if the pearl value is revealed and if the pearl value is not revealed, up to one lakh rupees at the current appraised value. Or both, goods worth up to four lakh rupees should be auctioned by the head of the office after taking the opinion of the head of financial administration branch, achievement accumulation officer, warehouse officer or warehouse assistant within one year. However, immovable property such as real estate cannot be sold by auction without the decision of the Government of Nepal and the Council of Ministers.
(2) Machine tools and heavy equipment and vehicles (except horses and bicycles) are in current condition, but old models, lack of spare parts and cost more in maintenance and operation and have submitted a report from a mechanical technician that they are unusable in the present condition. And if the head of the office determines that heavy equipment and goods with a pearl price or valuation higher than the value mentioned in sub-rule (1) should be auctioned, a committee should be formed according to sub-rule (3) to examine and survey such goods and recommend them.
(3) For the evaluation of goods mentioned in sub-rule (2), the following committee should be formed:-
(a) In the case of constitutional organs and agencies, ministries, departments and other central level offices, a committee of three people consisting of an expert on goods designated by the head of the office and a representative of the authorized level designated by the Comptroller General's Office under the chairmanship of the head of the relevant agency or an officer designated by him.
(b) In the case of offices other than the central-level office mentioned in clause (a), the committee consisting of the technical representative of the authorized level designated by the relevant chief district officer and the representative of the authorized level designated by the office of the relevant Treasury and Accounts Controller under the chairmanship of the head of the office or the officer designated by him.
(c) When appointing a technical representative, as far as possible, knowledge of the relevant commodityEmployees who are not available will have to be assigned.
(d) In the case of goods worth more than 10 lakh rupees or special type of goods, this committee can invite up to two technicians of related subjects.
(e) According to sub-rule (6) after conducting the necessary study and survey, if the price has not been fixed, this committee will also set the estimated price and give a recommendation report to the head of the office.
(4) After the recommendation of the committee as per sub-rule (3), the head of the general goods office will auction up to 10 lakh rupees if the price is open and up to 2 lakh rupees if the price is not open and both up to 12 lakh rupees. If the price is higher than the asking price, all bids must be submitted to the department if there is a department and to the ministry if there is no department.
(5) According to sub-rule (4), after receiving the report in the concerned department or ministry, the department or ministry shall form a committee with the following members to survey and evaluate the report. If the evaluation recommended by the committee as per sub-rule (3) is reasonable, the relevant department or ministry may give approval in support of the same:-
(a) Gazetted First Class Officer designated by the concerned Secretary or Head of Department – Chairman
(b) Engineer of concerned subject – Member
(c) Representative (official level), concerned office or ministry – member
(d) Head of Economic Administration Branch – Member
(e) Representative of the official level of the ministry or department designated by the relevant ministry or department - member - secretary
(6) The committee under sub-rule (3) or (5) while fixing the price of the goods shall fix the price by considering the utility, service life, depreciation, residual value and market value of the goods. While deducting the depreciation, it should be deducted at the rate according to the income tax law. While maintaining the value of goods that have not paid customs duty, the duty should be deducted including the customs duty. But the grounds so mentioned shall not apply in the case of any or partially non-deliverable goodsThe head of rhythm has to submit to the head of the department. After receiving information like this, the head of the department should ask the relevant experts to investigate whether the goods will be used or not. If the relevant expert gives a report that such goods cannot be reused even after repair or if the condition is as per sub-rule (16) after repair, the head of the department should give instructions to fix the price based on the same report.
(7) After the recommendation of the committee as per sub-rule (5) is submitted, the department or the ministry shall send it to the relevant office with an order for auctioning. After receiving such an order, the office will sell by auction according to sub-rule (8).
(8) After receiving the order to auction according to sub-rule (7) or after the decision to auction according to sub-rule (1) is given for fifteen days to auction goods up to one lakh rupees and twenty-one days to auction goods worth more than that, open notice including the following matters The auction should be promoted by publishing:-
(a) Description of Goods,
(b) Minimum price of goods,
(c) the place, time (starting and ending time) and date of the auction,
(d) Starting from minimum price,
(e) That a cash bond of five percent of the minimum price should be kept before the auction is held, and that the bond should be increased in the same proportion if the amount of the stamp increases,
(f) Time period for collection of auctioned goods,
(g) Other essential matters.
(9) Notwithstanding anything written elsewhere in this rule, if it is considered desirable to sell the goods by auction, the bid can be requested by giving a deadline in accordance with sub-rule (8). If the bid is invited in this way, a bank guarantee equal to ten percent of the bid amount or a voucher deposited in the bond account must be submitted with the bid. When asking for bids, arrangements should be made for procurement and filing of bids in the concerned office and taluk office.
(10) Conduct the auction in accordance with the notice published in accordance with sub-rule (8) or (9).The person, firm, institution or company who does not want to pay the following amount must buy a bid form with the signature of the head of the office or the employee designated by him and the seal of the office from the relevant office:-
(a) For bids with a fixed minimum price up to one lakh rupees, Rs. 300.-
(b) For bids with a fixed minimum price above one lakh and up to ten lakh rupees, Rs. 1,000.-
(c) Any amount above 10 lakhs for bids with minimum price of Rs. 2,000.-
(11) In order to enhance the auction as per sub-rules (8) and (9) or when publishing the notice of auction sale by asking for bids, if the pearl price is not disclosed, the goods which are valued up to one lakh rupees at the current valuation and goods which are valued up to three lakh rupees when the pearl price is revealed. The bid solicitation office, relevant district administration office, goods office, district development committee, and treasury and accounting controller's office may post a notice of invitation for bids in the auction sale office, and goods with a higher price may be auctioned by publishing a notice in a national newspaper. In this way, if the first time the auction is not successful, then the auction should be re-auctioned after seven days. If the auction cannot be held even after re-auction sale, it can be sold directly through negotiations without lowering the fixed price. If there is no sale even through negotiations, it can be re-evaluated and auctioned.
(12) If the auctioned goods are not paid the full amount within the specified period, the deposit will be forfeited and the acceptance points of the second, third or fourth lessees can be accepted. If the auction cannot be held even after doing this, the auction will have to be re-auctioned.
(13) If the sale is not possible through the procedure as per sub-rule (11), the auction shall be re-evaluated by the committee as per sub-rule (3) and (5). If the auction cannot be increased even at the re-evaluated price, the head of the office will initiate the relevant district administrationIt can be sold directly after fixing the price and taking the departmental approval in the presence of the representative of the office of rhythm and fund and controller of accounts. If it cannot be sold directly in this way, the cost will have to be deducted from the departmental decision.
(14) Apart from vehicles, machinery, tools and technical goods, the value of goods such as furniture can be fixed on the basis of the depreciation rate determined for income tax purposes without holding a committee. After the expiry of the life of any goods with fixed life, they can be evaluated by the committee as per sub-rule (3) and auctioned.
(15) According to this regulation, the taluk office shall inspect once a year and submit the report to the officer one level above regarding the auction sale or not.
(16) Notwithstanding anything written elsewhere in this regulation, the head of the office may sell by auction on the recommendation of the committee under sub-rule (3) if the goods are more than twelve years old and not in current condition, or if the cost of repair is more than twenty-five percent of the market value of the same goods to bring them to current condition.< br> (17) An item wise cost estimate should be prepared for the demolition and auctioning of the constructed physical structures and the cost of demolition and the proceeds from the sale of goods. If the amount received from the auction is more than the cost of demolition, the difference amount should be considered as the minimum price and action related to auction reduction should be taken.
